INTRODUCTION
These Terms and Conditions govern your banking relationship with Eminence Microfinance Bank Limited (“Eminence”, “the Bank”, “we”, “us”, or “our”). By opening and operating an account with us, you agree to be bound by these Terms and Conditions, as well as our:

Privacy Policy; and Cookies Policy.

If you do not agree with these Terms and Conditions, you must not proceed with account registration or use our services. We reserve the right to terminate your relationship with us if you breach any provision herein.

  1. INTERPRETATION
    “You”, “your”, or “Customer” refers to any individual who opens or operates an account with Eminence.

“We”, “us”, or “our” refers to Eminence Microfinance Bank Limited and any lawful assignee of our rights.

  1. ABOUT US
    Eminence Microfinance Bank Limited is a duly licensed microfinance bank regulated by the Central Bank of Nigeria (CBN). Customer deposits are insured by the Nigeria Deposit Insurance Corporation (NDIC), subject to applicable limits.

  2. NATURE OF RELATIONSHIP
    We provide digital banking services including savings, transfers, bill payments, and credit services. Upon successful onboarding, we will create and manage your account.

Access to our services requires:

  • A smartphone;

  • A valid phone number;

  • Compatibility with our mobile application.

  1. APPLICABILITY OF TERMS
    These Terms apply once an account is successfully created for you. We may amend these Terms at any time. Continued use of our services after notification constitutes acceptance of such changes.

  2. ACCOUNT OPENING AND ELIGIBILITY
    To open an account, you must:

  • Be at least 18 years old;

  • Be a Nigerian citizen;

  • Meet our KYC requirements;

  • Not hold an existing account with us.

We may revise eligibility requirements in line with regulatory changes.

  1. KYC AND IDENTITY VERIFICATION
    You agree to provide accurate and up-to-date information, including but not limited to:

  • Full name

  • Phone number

  • Email address

  • Date of birth

  • BVN

  • NIN

  • Residential address

  • Valid ID

  • Utility bill (if required)

We may verify your details with third parties and regulatory databases. Failure to provide accurate information may result in restrictions or account closure.

  1. ACCOUNT TIERS
    Accounts are categorized as:

  • Tier 1: Basic identification

  • Tier 2: Includes NIN

  • Tier 3: Full KYC with address verification

Each tier has defined transaction limits.

  1. ACCOUNT USAGE
    You may:

  • Receive funds

  • Transfer money

  • Pay bills

  • Use cards

You are responsible for ensuring transaction accuracy. We are not liable for errors due to incorrect input.

  1. ACCOUNT LIMITS
    Transaction limits apply based on your account tier. Transactions exceeding limits may be declined.

  2. SAVINGS PRODUCTS
    We offer savings options including:

  • Flexible savings

  • Fixed savings

  • Automated savings

Interest and withdrawal conditions apply as specified in the app.

  1. CARD SERVICES
    We may issue you a debit card. You agree to:

  • Use it lawfully;

  • Protect your PIN;

  • Comply with card network rules.

  1. FEES
    Applicable fees will be disclosed before transactions are completed.

  2. PROHIBITED TRANSACTIONS
    You must not use your account for:

  • Fraud or money laundering;

  • Illegal activities;

  • Unauthorized betting services;

  • Pornographic or exploitative services;

  • Weapons or dangerous goods;

  • Ponzi or pyramid schemes;

  • Cryptocurrency transactions (where restricted);

  • Any activity deemed unlawful.

We may block accounts and report violations.

  1. SECURITY OBLIGATIONS
    You must:

  • Keep login credentials confidential;

  • Use secure devices;

  • Avoid public/shared systems;

  • Report unauthorized access immediately.

We are not liable for losses due to your negligence.

  1. FRAUD AND AML MONITORING
    We may request details of transactions, including:

  • Source of funds;

  • Purpose;

  • Recipient information.

Failure to provide required information may result in restrictions or reporting to authorities.

  1. RESTRICTIONS AND SUSPENSION
    We may restrict or suspend your account if:

  • Fraud is suspected;

  • Regulatory obligations require it;

  • Risk exposure is identified.

  1. LIABILITY
    We are not liable for:

  • Delays beyond our control;

  • Third-party failures;

  • Incorrect transaction details provided by you.

You are responsible for losses arising from misuse of your account.

  1. ACCOUNT CLOSURE
    You may close your account at any time. We may also close or restrict your account if:

  • You breach these Terms;

  • Fraud is suspected;

  • Required by law.

Outstanding obligations remain payable.

  1. DATA PROTECTION
    We process your personal data to:

  • Provide services;

  • Improve products;

  • Comply with legal obligations.

We may share your data with affiliates and regulatory authorities where required.

  1. MARKETING
    You consent to receiving marketing communications. You may opt out at any time.

  • SMS.

You are responsible for keeping your contact details updated.

  1. INTELLECTUAL PROPERTY
    All trademarks, logos, and content belong to Eminence or its licensors. Unauthorized use is prohibited.

  2. GENERAL PROVISIONS

  • Severability: Invalid provisions do not affect the rest.

  • Taxes: You are responsible for applicable taxes.

  • Entire Agreement: These Terms supersede prior agreements.

  1. GOVERNING LAW
    These Terms are governed by the laws of the Federal Republic of Nigeria.

  2. DISPUTE RESOLUTION
    Disputes shall first be resolved amicably. Failing that, Nigerian courts shall have jurisdiction.
